PAIA Manual
Manual in terms of section 51 of the Promotion of Access to Information Act, 2 of 2000 - explaining what records Phirima Lodge holds and how to request access.
1. Introduction
This manual is published in accordance with section 51 of the Promotion of Access to Information Act, 2 of 2000 ("PAIA"), and explains how a requester may access records held by Cape Gannet (Pty) Ltd, trading as Phirima Lodge ("the Company").

4. Records Available in Terms of Other Legislation
Certain records are kept in accordance with, amongst others: Companies Act 71 of 2008, Income Tax Act 58 of 1962, Tax Administration Act 28 of 2011, Value Added Tax Act 89 of 1991, Basic Conditions of Employment Act 75 of 1997, Labour Relations Act 66 of 1995, Compensation for Occupational Injuries and Diseases Act 130 of 1993, Unemployment Insurance Act 63 of 2001, and the Protection of Personal Information Act 4 of 2013.
5. Categories of Records Held
- Company records: incorporation documents, share register, minutes, resolutions.
- Financial records: accounting records, financial statements, tax returns, invoices.
- Personnel records: contracts, payroll, statutory employment records.
- Operational records: reservation correspondence, guest registers, supplier contracts.
- Statutory records as required under POPIA and other legislation.
6. Requesting Access to a Record
Requests must be made on the prescribed form (Form 02 of the PAIA Regulations) and submitted to the Information Officer at stay@phirimalodge.com. The request must:
- Provide sufficient detail to identify the record and the requester.
- Indicate the form of access required.
- Specify a postal address or email in the Republic.
- Identify the right the requester is seeking to exercise or protect, with an explanation of why the requested record is required.
- Be accompanied by the prescribed fee, where applicable.
7. Grounds for Refusal
The Company may refuse a request on any of the grounds set out in Chapter 4 of Part 3 of PAIA, including (without limitation): protection of personal information of third parties, commercial information, confidential information, and records privileged from production in legal proceedings.
8. Fees
The fees payable for requests are those prescribed by the Regulations published under PAIA, and may include a request fee and an access fee. Personal requesters are not required to pay the request fee.
9. Remedies
A requester who is dissatisfied with a decision may lodge a complaint with the Information Regulator or apply to a court of competent jurisdiction in accordance with PAIA.
10. Availability of this Manual
This manual is available on our website at phirimalodge.co.za/paia and at the registered office on request. A copy may be provided in an alternative format on request.
